BabyMix Terms of Service

1. Who provides the service, and what you accept

BabyMix is an Android app (com.babymix.app) provided by Secure Online Managements SL, VAT ESB01794866, registered at C/ Creueta 20, 08870 Sitges (Barcelona), Spain.

By installing or using BabyMix you accept these terms and the Privacy Policy published at https://babymix-30feb.web.app/privacy, which forms part of them. If you do not accept them, do not use the app. Google Play's own terms also apply, since Google distributes the app and handles payments.

2. What BabyMix does, and what it does not

BabyMix uses artificial intelligence models to generate an imaginary image of what a baby might look like, from the photos of two adults, plus related features: a similarity percentage, a family portrait, an interpretation from an ultrasound scan, and a short video of the generated baby.

The result is entertainment. It is not a prediction, a diagnosis, a genetic analysis or a parentage test, and it has no medical, scientific, legal or evidential value. The "similarity %" is an approximate measure between images, not a biological fact. Do not make any decision, medical or otherwise, based on what this app produces.

AI models are probabilistic: two generations from the same photos can differ, and some results may not be to your liking. That is not a defect of the service and, absent a technical failure, does not entitle you to a credit refund.

3. Who may use it

• You must be 18 or older. BabyMix is not directed at minors.
• You need an Android device compatible with Google Play that passes the Play Integrity check. Without a valid verdict no session is created and no free credits are granted.
• The app is distributed only in the United States, United Kingdom, Canada, Australia, Germany, France, Spain, Italy and the Netherlands, with an interface in Spanish, English, German and French.

No registration is required: the app runs on an anonymous session. You may link a Google account only to recover your credits when changing phone.

4. Your photos: what you warrant

By uploading a photo you represent and warrant that:

1. You are the person shown, or you have their express permission to use their likeness for this purpose.
2. If the photo is of a baby or a young child, you are their parent or legal guardian and you are uploading it in that capacity.
3. Photos in the mum and dad roles are of adults.
4. You hold the rights needed over the image and its use here infringes nobody's rights.
5. The photo contains no nudity, sexual content, violence, gore, hate symbols or illegal material.

You grant us a limited, non-exclusive, royalty-free and revocable licence to store, process and transmit that photo to our moderation and generation providers for the sole purpose of producing the result you asked for, for the period stated in the privacy policy (24 hours for input photos). That licence does not let us publish them, pass them on for other purposes, use them in advertising or train models on them, and it ends when the file is deleted.

5. Acceptable use

You may not:

• Upload photos of children who are not in your care, or attempt to generate images of minors outside the case in 4.2.
• Use the app to create sexual, violent, defamatory, discriminatory or illegal content, or to impersonate anyone.
• Pose as another person, or generate images of real people without their permission in order to deceive, harass or harm anyone.
• Circumvent moderation, the watermark, the credit system or the integrity check; automate use of the app; reverse-engineer the client or the service; extract our prompts or models.
• Claim free credits repeatedly by deleting the account, reinstalling or tampering with the device, or falsify ad rewards.
• Overload the service or bypass usage limits.

We may refuse a generation, withhold a result, restrict use or close an account that breaches this section, refunding the credit where the refusal happens before generation.

6. Credits

Everything the app generates costs credits. Balance and charging are always decided on our server.

How you get them

What each thing costs (the app always shows the current costs, which it reads from the server catalog):

Rules

• Credits that expire soonest are spent first (welcome, rewarded and subscription, in that order), and pack credits last, since they do not expire.
• The credit is charged when the generation is queued and is refunded automatically if the job fails, if moderation rejects the photo, or if no result is ever produced.
• Credits are not money: they have no value outside the app, cannot be transferred, sold, exchanged for cash or cashed out, and are valid only inside BabyMix.
• Free and rewarded credits are a courtesy: we may change their amount, their limits and their expiry going forward, without affecting credits already granted to you.
• An active plan unlocks: results without a watermark, HD saving at no extra cost, and the Pro features (family portrait, ultrasound and video). The 100-credit pack does not unlock the Pro features: it gives balance, not a plan.

7. Subscriptions, packs and payments

• Purchases are made inside Google Play, with your usual payment method. We do not process payment data.
• Starting prices are EUR 5.99 per week (weekly plan), EUR 49.99 per year (annual plan) and EUR 4.99 for the 100-credit pack. The price, currency and applicable taxes are always the ones Google Play shows in your country at the time of purchase.
• Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. You can cancel at any time in Google Play → Payments and subscriptions → Subscriptions. Cancellation takes effect at the end of the period already paid for: you keep the plan until then and there is no pro-rata refund.
• If you change plan, credits already granted by the plan you leave follow the expiry rules of their own lot.
• Refunds. These are handled by Google Play under its policy. If you believe there has been a billing error or an incorrect charge, write to support@som.company and we will look into it. If a refund goes through, we remove any unspent credits granted by that purchase.
• Right of withdrawal (EU). As a consumer in the European Union you have 14 days to withdraw from a distance contract. When buying credits or a plan you expressly request immediate performance of the digital service and acknowledge that you lose the right of withdrawal as soon as you start spending the credits from that purchase. While none has been spent, you may exercise it by writing to support@som.company.
• If we discontinue the service permanently, we will stop renewals and deal with unspent pack credits as applicable law requires.

8. Ads

BabyMix shows rewarded ads only, and only when you ask for one in exchange for a credit. There are no banners, no interstitials, no app-open ads and no other format. Watching a full ad grants the credit once Google AdMob's server-side verification confirms it; an interrupted or repeated ad, or one whose verification never arrives, grants nothing. The limit is 3 ads per device per day.

9. Rights in the results

• Your photos remain yours. We acquire no rights in them beyond the limited licence in section
• The generated results are yours. To the extent the law recognises rights in an AI-generated image, we assign them to you and you may use them for personal and commercial purposes, provided you have complied with section 4 and you respect the likeness rights of the people in the source photos.
• Results without a plan carry a watermark. Removing, cropping or masking that watermark without paying for HD breaches these terms.
• An AI-generated result is not necessarily unique: another user with similar photos may get something similar, and we do not guarantee originality or registrability.
• Everything else remains ours: the app, its design, its brand, the catalog, the prompts and the service.

10. Moderation and suspension

Every input photo goes through automated moderation before anything is generated, and results are reviewed before being served. A rejected photo never reaches a provider and the credit is refunded. Automated systems get it wrong in both directions: if you believe a legitimate photo was rejected in error, write to support@som.company.

We may suspend or close your account, without refund, for serious or repeated breaches of section 5, in particular attempts to generate content involving minors outside what is allowed, or attempts to circumvent the credit system. Where reasonable we will warn you first.

11. Availability

We do our best to keep the service available but do not guarantee uninterrupted operation: it depends on third parties (Google Play, Cloudflare, the AI providers) and can be interrupted by maintenance, incidents or spending caps. The times shown in the app (under 40 seconds for a photo, under 3 minutes for a video) are targets, not contractual promises. We may change, add or withdraw features; if a change materially reduces what you paid for, we will give you reasonable notice.

12. Warranties and liability

The service is provided "as is". To the extent the law allows, we exclude implied warranties of fitness for a particular purpose or of accuracy of results.

Nothing in these terms limits our liability for wilful misconduct, gross negligence, personal injury, or any liability that cannot lawfully be excluded, including the rights you have as a consumer. Outside those cases, and to the maximum extent permitted, our total liability to you is limited to what you have paid in BabyMix in the 12 months before the event giving rise to it, and we are not liable for indirect loss or loss of profit.

13. Account deletion and termination

You can stop using the app and delete your account whenever you want:

• In the app: Profile → "Privacy" → "Manage my data".
• On the web: https://babymix-30feb.web.app/delete-account.

Deletion removes your files from the server, your generations, your credits and your account, and also what the app stored on the phone. Unspent credits are lost and are not refunded, and deletion does not by itself cancel a subscription: that is done in Google Play. The exact breakdown of what is deleted and what is kept is in section 11 of the privacy policy.

We may end this relationship on reasonable notice, or immediately if you seriously breach these terms.

14. Changes

We may amend these terms. The version in force will always be at https://babymix-30feb.web.app/terms with its date. If a change materially disadvantages you, we will tell you in the app before it applies; continuing to use BabyMix after that date means you accept it.

15. Governing law and complaints

These terms are governed by the laws of Spain, with the courts of Barcelona having jurisdiction unless mandatory consumer law grants you another venue. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring proceedings in its courts.

Before making a claim, write to support@som.company: almost everything is resolved that way. As a consumer in the European Union you may also use the alternative dispute resolution bodies in your country.
